Refusal of Tier 1 Dependent Visa

Post by successatlast » Wed Mar 30, 2011 3:58 pm

My husband's Tier 1 Dependent visa was refused for maintenance funds under 319(h)(g).We have been given right to appeal. We had submitted stamped and signed statements but they refused saying that bank logo is not there.I had the following queries
1) Along with the appeal form my husband is submitting original bank statement of the photocopy we sumitted to VFS.It is exactly covering the same period of time from 6th August to 7th march.Would this be sufficient or the statement has to be till todays date or less than 28 days etc. Please help.
2) My husband has valid tier 1 visa till June 2011.Can he travel to UK while he appeals against the decision in Mumbai.Would he have any problem coming back.Plz help.

My husband is planning to travel next week.I need help with following queries
1) He is on valid Tier 1 Visa till June 2011.He is appealing against the decision next week. Can he travel on his valid visa or would it be advisable for him to wait for appeal.
2) Can he be questioned for his visa refusal
3) He is planning to submit the appeal personally at BHC but was advised that he will not receive any acknowledgement. Is it necessary to submit documents by courier. Can someone help.

My questions might be a bit silly but it is very stressful period for us as immediately after our marriage this has happenend and only for a missing bank logo. They did not consider the sign and stamp which the bank said should be sufficient.Your help would be appreciated as I was unable to find information regarding refusal of visa (switching) while on diff visa and travelling back to UK.Many thanks.

He may travel. But, if and when the appeal is upheld and BHC asks for his passport, he will have to submit the passport at BHC where the entry clearance application was submitted. He cannot request for the passport to be stamped in UK.

May be. But this wouldn't be a problem.

It is always better to send appeal papers in a manner that you receive a confirmation of delivery (just in case you need to prove some day that you had indeed submitted an appeal).
Life isn't fair, but you can be!

My husband appealed against the decision of refusal of maintenance fund by personally submitting documents at BHC Mumbai on 6th April. We have not received any acknowledgement letter and no one picks the phone at BHC Mumbai. My query is
1) Do you get acknowledgement letter for the documents submitted in person. Is this common???
2) Anyone knows any number to contact Mumbai BHC for appeals section. No reply received for email as well.

Hi Successatlast ,

i have same problem. i did my wife's appeal on 14th of april at uk asylum and tribunal and they sent it to bombay embassy on 3th of may and still i am waiting for result.

my question is you got your appeal reference number or not yet. becoz its now 2 month about your appeal. so you got any letter or not.
now what you do call to asylum and tribunal and ask them i did appeal on this date and tell them your detail so they will tell they got your appeal or not and the number of asylum and tribunal is +443001231711.
so you will get the real answer.
and you have bombay embassy number then please give me.

thanks
