ILR for Dependents

Hi Group,

Recently I got my ILR settlement visa,my spouse and new born kid came here in September 2010 on tier1 dependent visa,theier visa will expire in
May 2012,the following are my queries.

1.Can they stay in UK on Tier 1 dependent Visa till May 2012
2.Can I add them when I am applying for the British Citizenship.

Please suggest on this.

1. Why did you not include your child in your settlement application (as a dependant)? There is no "residential requirement" for minor child(ren). (319J)
2. Anyhow, reading this topic should help.

One must have settled status before one can become eligible for naturalisation.

I didnt know that I can include my kid during my ILR application,can you please suggest me how can I proceed now with my Kid ILR application.

If the technical change as posted in the linked topic above (click on the second link provided) comes into effect, then your child should be able to apply for settlement separately .. as a dependant of Tier 1 (General) migrant.

Wait for more information regarding the technical change to become available.

Hi Susmedha,

In that case I have few points:

1.Is my 14 months old baby needs to wait for 2 years time spend in UK to apply for ILR.
2.Can't I apply directly citizenship for her along with my application i.e in 2012.
3.Which form I need to use for my Kid ILR
4.As my spouse and kid tier1 dependent visa will end in May2012 and there will be shortage of 5 months for their 2 years time spend period,do I need to apply for any visa for this 5 months period.
