visa requirements after marrige

Post by jamesnixon » Fri Apr 08, 2011 10:19 am

Hi I'm. UK citizen and am shortly marrying my fiance who is from Sri Lanka. She was originally on a student visa and for the last 16 months has been a Tier 1 post study worker.

We believe the best course of action is to apply using flr(m) for an extension to her current visa and she could then apply for ILR after 2 years. Is this correct? Any way to secure ILR straight away?

Also some friends said my fiance may have to travel back to Sri Lanka to apply after the wedding... Surely this is incorrect![/quote]

Since she's already in the UK legally - and you'll have a COA to marry - then she can switch from the UK.

Unless the wedding is from 9 May. Switch after marriage if she has leave left.

Greatly appreciated. I thought that was the case.

For info- wedding is after the 9 May but got COA a while ago before changes to law.

Thanks again
