Absent from UK Vs Out of Job in UK

I want to understand compare two different cases for ILR.

Case 1: If someone has been on Tier 1 for 5 years and has been ABSENT from UK for continous 4 months while on Tier 1.

Vs

Case2: If someone has been on Tier1 for 5 years and has been out of work in UK for continous 4 months while Tier1 being still valid .

In both cases NI will not ne payed and no salary will be received !

Will these two cases be treated differently for ILR ?
