5 yrs LL how to apply for dependants reunion (brothers)

Post by muchieb » Sat Apr 09, 2011 12:16 am

Hello Everyone

Firstly I would like to apologise if I have posted a question that has been asked and responded to before.

My question is as follows. when I applied for asylum I was granted refugee status 5yrs Limited Leave. I am originally from Zimbabwe. This was granted in June 2009. when I made my application I made note of everyone who was dependant on me since both my parents are late. My son (who has since joined me via family reunion) my brothers x 4 (2 sets of twins). the forst set of twins a have since turned 21yrs so will not be eligiable to join me as dependants although they are still dependant on me.
The other set of twins will be truning 18yrs in November this year. One of the younger twins suffers from autisim (also mentioned on asylum application and mentioned when interviewed) and will never be independant.
I have previously sought legal advise for the 17yr old to join me via family reunon or any other means but i was informed that because the boys are living on other own in Zimbabwe they would not be considered as dependant on me even though I explained that I have/had evidence that financially I take care of them, by sending money for their welfare every month.
What I would like to know is whether I could still apply for the two young ones on the basis of them being my dependant and also state that one is autistic and needs 24 hr care which the elder boys can not provide if they start families or move on to live independantly?
What type of visa would I need to apply for if they can not join me via family reunion?
Since they are twins I would not want to seperate them as they are fond of each other.
Any help will be very much appreaciated.
thank you in anticipation

You should apply for family reunion for them. You need to prove that they are dependent on you and that this was the case before you left Zimbabwe.

You also need to show that there are compelling compassionate circumstances since they are not your children and therefore do not automatically qualify for family reunion.

When did you leave Zim and when did you claim asylum?

who has been looking after your brothers since you left? Who are they living with now?

Read the family reunion ECG unfortunately the section on other dependent family members is currently under review so there is not much information there.
