Hi friends,

My name is Mrs. Mohsin, I am in the middle of an ILR dilemma, so details are as under. Please advise.

1. Work Permit was on 23 March 2006 for 60 months from the date of leave to enter salary £18327.00 per annum
2. Leave of Enter: 21 April 2006 till 21 April 2011 ( Entry Stamp 5 May 2006) – 28 days period to qualify for ILR starts from 7th April 2011
3. SET (O) Application made online on 26/03/2011
4. Payment made £1950 for premium service
5. 1st Appointment Cryodon Home Office on 31st March 2011 which was rescheduled to meet minimum 28 days.
6. 2nd Appointment Sheffield Home Office on 8th April 2011
7. Current Fees Oct/Nov 2010 fee paid £1250 main applicant £350x2 dependants (fees revised on 6th April 2011 which does not apply to me.
8. Rules revised on 6th April 2011 does not apply as I assume the application was submitted before this date. Point to refer is No.7 above new fees does not apply.
9. Job title does not fall in the Closed Categories (whose ILR routes are either closes or are complicated at the moment)
10. On the appointment day a letter was given to me to provide the following documents to UKBA to consider the ILR application
a. Employment Contract
b. Letter from employer explaining your current role, specifying your hourly rate of pay and the hours you work per week and how if applicable, your hourly salary has progressed since commencing employment with them

Having considered the two requirements in point (b) i.e. current for, hourly rate and salary progression, a considerable research is conducted in the Standard Occupations Classifications (SSC 2000) and Occupational Codes of Practice 2000 Tier 2 which is detailed hereunder:

As per old occupational code and new 2000 code the Job Title Manager, business development SOC 1132 applies per rate £15.88 per hour.

Current scenarios:

1. Salaries during the 5 years of work permit varied. P60 provided to UKBA (2006-07 £9000, 2007-08 £14749.27, 2008-09 £16000 and 2009-10 £8929.20 (Due to maternity Leave)
2. Shabana could have a job offer (tier 2 Work Permit from another employer) they have already applied for CoS with the category Business Development Manager, but results are still awaited. The job offers £28K on the letter is offered. Would this offer help to support the case?
3. Employer is a small business with franchises and property devolvement, therefore, the salaries varied, whereas, company provided car, petrol, accommodation and performance based bonuses, therefore, I am happy with the employer.

4. If the ILR is turned down, would there be possibility to get new Cos from the new employer at a higher salary rate? (if that is the case than what about 5 years of Work Permit Duration)

5. I entered country first time November 2003 on student visa and remained on the same until work permit on 21 April 2006. Work permit was issued after completing Post Graduate Diploma from London. Total duration in UK on legal visa: 7 years 5 months in the month of April 2011. Being on a valid visa for 10 years qualifies for ILR. Do I need to source ways to extend visa for the extension if the ILR is turned down.

I'm confused. You said you had an in-person appointment on the 8th which was two days ago. Yet you are asking "if" ILR is refused. What happened at your appointment?

Also, just to clarify, if you filled out the interactive application that is uploaded then you pay and then you download and print to use, that is not applying online. That is just using their online system to create the application. The application is made when they receive it by post or you present it in person at a PEO.

When I went to appointment they gave me letter to provide (a) and (b) on my message by 22 Apeil 2011.
