marriage visa age and pregnancy

Post by TC5362 » Sun Apr 10, 2011 4:16 am

My wife is due to give birth in may but her 21st birthday is end june. She's british and already in the uk, iam in south africa. My question is; can I make my visa application before her 21st birthday so I can be present at the birth of our child since its only a month? We have everything except she's giving birth a month before her 21st birthday and am scared iam going to miss my childs birth. Please help,

SET3.5 What is the age requirement? wrote:In cases where the applicant is within a couple of months of their 21st birthday, and the other party is 21 or over, the ECO has discretion to issue entry clearance but  valid only from when the person under 21 has reached their 21st birthday.

Does that mean its not possible to get entry clearance a month before my wife's 21st baby?b even if we have all the letters from the doctors about the expected dates of our childs birth? Thanks for your reply.

Unfortunately, probably not. Unless they can use discretion to override the current rules.
