FLR (M) A1 Test

FLR (M) A1 Test

Thank you for looking at my post.

It is regarding about my wife.

My wife came to UK about 2 years ago. At that time, she didn't need to take this A1 level English test for applying spouse visa. After she spent 2 years in UK, unfortunately her English is still very bad and I don't think she will pass the A1 Test.

We thought at that time, we just can apply FLR (M) if she cannot pass the Life in the UK test, so I was not worried about it so much. But things has changed now because of this new rule.

My question is, is she deported if she cannot pass this test after she spent 2 years in UK?

If sh'e unable to pass the A1 or Life in the UK test she may well be given a further 2 year discretionary leave visa. Has she looked at the option of enrolling on an approved ESOL course? When does her current visa expire?
The A1 test is very basic spoken English...every day words and phrases.

Well, I didn't know about discretionary leave visa.
Thank you for letting me know.

And about ESOL course, I've sent her so many times but she couldn't learn much and always gave up quickly.... she's never passed any tests...

A recent case where applicant had applied for FLR(M) but did not provide evidence of English test ... and was granted discretionary leave instead.

Not sure if it is a practice (granting discretionary leave if FLR(M) is refused for any reason) or a mistake (FLR(M) refused and applicant is then required to apply for discretionary leave separately).

It could be that the Home Office are aware that if they refuse FLR(M) due to not meeting the new English test requirement, it would be overturned at appeal. Hopefully they may amend this as at present it's a 'Catch 22'
situation..i.e you have to apply for an extension due to the fact that your understanding of English doesn't enable you to pass a KOL test or complete and ESOL course...but you have to pass an English test in order to qualify for the further leave extension!! :shock:

The level is so basic - can you not help her to get to this level. Is she not getting out in the last 2 years, 2 years exposure should have got her to this level

I looked at the recent case, it has given me a bit of hope. Thank you. We don't have any kids and she's just been here for 2 years, so I really don't know UKBA can give her discretionary leave....

She will apply for FLR(M) but I know it will be refused. I've kept saying to her studying English hard! but she hasn't listen to me.

I did my best to help to improve her English through this 2 years, but if someone is not eager to learn it, it is too hard to help. This is why I've sent her many times to college learning English but sometimes she hasn't attended the corse. I've helped her homework during the weekend but as I said, she didn't care about it. :cry:
