Post by Charliewhite » Thu Apr 21, 2011 2:27 pm

Dear Seniors,

Is it mandatory to tier 1 dependant need to take the English language Test? Is there any new requirement added from April 6th 2011. I’m little confused with below link.

http://www.vfs-uk-in.com/news.aspx
19 April 2011: New list of English language providers to be mandatory from 18 May.

http://www.ukvisas.gov.uk/en/aboutus/ne ... =585598282
Visa Services New list of English language test providers to be mandatory from 18 May 2011

Can you please help me with below question?

Planning to apply Tier 1 dependant visa for my wife on mid of 17th May 2011. Does my dependant need to take the English language test?

It is not required for a dependant, it is meant for Main Applicant or as a spouse of the main applicant who is on ILR or British Citizen

Hi,

I am a little confused with contradicting ideas. Could anyone of you please clarify the right approach?

Topics which DO NOT suggest the need for English knowledge for Tier 1 dependents are:

1) http://www.ukba.homeoffice.gov.uk/sitec ... icants.pdf
(search for 'Tier 1')

2) Few other posts in this forum

Topics which seem to suggest that need for English knowledge skills for necessary for Tier1 dependents:
1)In 'http://www.ukba.homeoffice.gov.uk/polic ... 1migrants/'. Search for the statement 'The requirements to be met by a person seeking leave to enter the United Kingdom as the spouse or civil partner of a person with limited leave'.

2) This link does not mention the type of dependents it is appplicable: http://www.ukba.homeoffice.gov.uk/sitec ... e-partners

3) I called up UK Home office today and they seem to say (with a little confused mind) that ability to show English is applicable for all types of dependents. They asked me to check with the local embassy for more details.

you only require test of english if you want to join your SPOUSE who is on ILR or a BRITISH CITIZEN and you intented to apply for a SPOUSE VISA.

ALL PBS dependants do not require Test of English

THis link above states requirement for English test if you are applying for Indefinate leave to remain as a parnter/spouse. NOT FOR FLR which is further leave to remain in the UK as a dependant of t1

Hi,
Thank you very much sir, i was confused by looking at the following link

http://www.ukba.homeoffice.gov.uk/sitec ... h-language

http://www.vfs-uk-in.com/news.aspx

12 May 2011: New list of English language providers - Transitional arrangements. On 6 April 2011 the UK Border Agency published a new list of English language test providers. For Tiers 1 and 2 of the Points Based System, tests that have been booked or taken with the existing list of providers can be used in applications as long as they are received by the UK Border Agency on or before 17 May 2011. From 18 May 2011 only tests taken with providers on the new list can be used for Tier 1 and 2 visa applications. For spouse or partner visa applications, you may use a test with an existing provider in an application received on or before the 17 July 2011. From 18 July 2011 all spouse or partner visa applications must be submitted with evidence from a provider on the new list. For further details please visit the UK Border Agency website.
