I posted this topic in ILR forum, but guided by the moderator to post in this one. Following is my case, would really appreciate your suggestions/advice:

Basically my wife has been out of uk since 9 months after staying together as dependant(HSMP holder,me) for around 2 years in UK. Since then my visa status has been changed from HSMP to ILR. she has her old dependent visa until may2011 but as it wont be considered valid will have to apply again.

I have compiled following list to apply for her leave to remain in the UK as a dependent of settled person. As she has already stayed in the uk for approx 2 years(including few holiday break of less than 90 days outside country) will she get indefinite leave or still get a 2 years probationary visa?

1) Apply using a VAF4A form
Documents
- marriage certificate
- letter from her college that the instruction was in english. (Does she need to get NARIC approved?)
- my last 3 months bank statements + payslips (not mentioned in guide, is it really required?)
- proof of my residence

She should be granted a 27-month spouse visa.
