when to apply indefinite leave for wife

I am EEA citizen livin here in Uk who has been granted 5yr working permit and also five yrs for my wife. Both me and my wife are in full time employment. it been 3yrs since we had this permit but am wondering how early can I apply for indefinite for my wife

I am confused. As an EEA Citizen you do not require a Work Permit to work in the UK! Do you mean you have a Residence Permit?

Your wife? Is she also an EEA Citizen?

In any case it seems that the answer to your question is that after nearly five years exercising treaty rights in the UK it will be possible to make applications for Permanent Residence ... ILR ... indefinite leave to remain. When did you are your wife actually move to the UK to exercise treaty rights .... that is, to work.

sorry am on resident permit and she is Non EEA citizen she came here 3yrs ago and has been working since so when is it possible to apply for the indefinte

Hi, sorry to say that neither of you can apply for Permanent Residence until shortly before the expiry of five years exercising treaty rights in the UK.

Until changes introduced on 03.04.06 the answer would have been .... 4 years .... but now thanks to that change of legislation the answer is clearly 5 years needed .... so both of you have approximately another two years to go.
