HSMP and working outside UK

Post by cuberoot » Fri Jul 07, 2006 9:09 am

Hi

I have a question. I will be applying for an HSMP visa in July.

What are the rules regarding working outside the UK on the visa? I may have an opportunity to work for a company that requires lots of travel outside the UK. The company is based in the UK and my salary will be paid into a UK account.

I know there is a rule that says that you cannot be out of the UK for a period longer than 3 months, and 6 months in total if you want to apply for ILR after 5 years? Do periods outside the UK for work purposes also fall under this rule?

Thanks.

I would appreciate some advice. The guidance notes I have read are not clear about time outside the uk for work purposes.

If you spend 3 months outisde the UK, even if it's work related, your ILR 'clock' will get reset to zero.

Does that apply for business travel because that seems unfair. What is the effect on hsmp extension?

Paragraph 22 of the guidance:

"Secondments abroad that are an integral part of a job based in the UK are permitted by Work Permits (UK), however they will be considered as time outside of the UK for settlement eligibility purposes. To qualify for settlement in the UK you must have spent a continuous period of five years in the UK except for short holidays or business trips. Any secondment that requires you to be outside the UK for an unbroken period of over three months will make your previous stay in the UK ineligible as a continuous period in the UK."

So it won't affect an extension.

Hi

Thanks for the help. That has cleared up a lot. So if I spend 3 months in total abroad each year in multiple short trips, would that reset ILR clock? It seems to be at the discretion of HO.
