Discretionary leave status to citizenship

Post by Stella101 » Tue Apr 26, 2011 8:02 pm

Hi,

Please may I pick some knowledge on the following issue.

I have been in the UK since 1998, and post being a student, in Feb 2005 I went onto my husband’s South African passport as a dependant as he was on a work permit. I am also on a SA passport. Every year or so since then as my husband had his work permit renewed and then moving onto HSMP my passport would accompany his and we would go through the necessaries with me as his dependant.

When we applied for Indef leave in June 2009 (my husband would have been on the work permit/HSMP for 5 years in the Aug-09 but had to apply then as the current HSMP was expiring in June 2009) UK Home Office advised that we had to apply in our own rights which also cost us 2 x individual fees. The reason for this was that because my husband was short those two months we both had to apply under the 10 year status.

Whilst my husband received Indef leave I was given discretionary due to a date technicality where the Home Office receiving the passport for application and existing visa status expired and so had a couple days interim with no defined visa status.

This said we both wish to apply for UK citizenship and obviously cheaper if we do it together. I was granted discretionary leave in Dec-09 and the period was for 3 years.

As I am on this discretionary leave status what can I do? Can I also apply with my husband for citizenship now?

Thanking you in advance.

It is appreciated.
