Hi,

I have applied for a T1 dependent visa for my new born baby in India.I made this application in Nov 2010. I got the passport back after almost a month saying that the application is rejected. The reason they cited was maintainance, which was really stupid. I have 2 types of account with my bank i.e Savings & Current. In the refusal note they said that on a particular day in my Current account funds were below the stipulated amount, but the stupid guy overlooked the fact that in my Savings account on the same day the funds we more than couple of thousand pounds. I'm very sure that I have maintained the required funds for 3 months between the accounts. The structure was like, during Month 1, I maintained around 2000 pounds in my current account and on 15th of that month I transferred it to my Savings account, and maintained it there for the rest of the time. I did attach both the original account statements as well.

Now to the core issue, since they rejected it and I felt that this was a straight forward case, I appealed.Y'day 3 months have been completed since I made the appeal and there is no reply to it. I send them a mail regarding this and the reply I got was that they have send my bundle to UK.

My questions to experts are:
- Why have they not reviewed it?
- Can I get a solicitor in UK to be present for my case,even though I have opted no in person presence required in the appeal form.
- If I get a solicitor how fast can I get an appeal hearing?
- Is there any chance they will review the application at post now?

Can you please help me?

They have, but decided not to change the decision and forwarded the appeal to the tribunal in UK.

You'll need to check with the tribunal if you can amend the details you entered in the IAFT-2 form.

AFAIK, hiring a solicitor doesn't influence when your case will be heard / decided.

Do you know how much time it takes for an appeal hearing once the bundle reaches the tribunal?

They have informed me that they have send the bundle to tribunal on 14 April 2011.
