ILR Application 2 driving offences in 8 yrs of UK WP

Post by sreevi » Thu May 05, 2011 2:57 pm

Hi,

My husband has been in UK on Work Permit visa since September 2003 and have been working in the Hotel industry here since. His papers in terms of income and statements are all in order.

The only concern is that he has two driving offences(not sure if they would be criminal offences) one in 2008 where he was driving using an International license over the allowed time line for which he was given 3 points and asked to pay a fine.

The other offence was for driving without insurance in late 2009/early 2010 where it was a miscommunication with the Insurance company where they had cancelled his policy but wasn't informed and he appealed about it for which he wasn't given any points but was given a ten day ban and a fine.

Could you someone please advise if there is anyway he can apply for settlement now and get it? I was told by a friend that there have been a lot of changes around settlement rules and criteria which could mean he won't be able to apply now and would have to wait 5 years from the date of offence/ban/fine. It would really help us if anyone could guide or advise us.

Thanks
Sreevi

1. Find out if there is any unspent / spent conviction on record.
2. If there is a unspent conviction on record, then one must until the conviction becomes spent.
