Visit to marry then leave

I am a USC. Can I come to the UK and marry my English fiance and then return to the US to file a spouse visa so that we can skip the fiance visa fee? I've read about the visit visa to marry, but do I need one since US is part of VWP? Any clarification would be appreciated! Thanks.

41(x) is still in place. Moreover, 56E still requires 56D(iv).
