ILR 6 months absence

Post by mujtababw » Sun May 08, 2011 10:25 pm

Hi,

I had a workpermit which got converted to Tier 1 this year.

I entered uk on 09th July 2006 and had to go back to home country on 22 Oct 2006. Reason to go back was wife was pregnant. My son was born in february 2007.

After 189 days of absence, I came back to UK on 29th April 2007 and have been continuously staying in UK since then. I have some small absences but they are all paid leaves and holidays less than 1 month during this second stay. During these days my daughter was also born in July 2009 in UK.

I need advice for the below queries:

1) Can I apply for ILR in 2011 July.

2) If not, then when can I apply keeping in mind my first entry in July 2006.

3) If my first entry is not applicable then do I need to forget about it and wait another year to apply for ILR. That means my calculation of eligibility days start from my second entry, that is, 29th April 2007.

Any advice on this will help me greatly to apply for ILR.

Thanks
M

Hi mujtababw
My case was exactly the same as yours. Unfortunately the clock resets after 180 days of absence. I don't think pregnancy can constitute a valid reason for 180 days of absence.
