PLEASE HELP - Very urgent EC queries!!!

Post by YV » Sat Jul 15, 2006 4:12 pm

Dear all Members & Moderators,

I have posted this query for about 3 weeks and no one seem to be able to answer my questions (or are they ignoring me?). Time is ticking away for me and I need some answers soon. Can someone please answer some of my queries?

I am in the process of applying for EC and have a few queries especially in regards to funds/finance. I am applying from Australia and my queries are as follow:

1. By the time I apply for EC in early October, I would have about 4000GBP in my savings, a car which I plan to dispose (worth about 3200GBP) and some shares worth about 1500GBP. So all up, I will have about 8700GBP at that time. My partner has about 4000GBP in savings and 1800GBP of shares.
- My question is, since my partner is my dependant, should I transfer his money into mine now (to increase fund evidence to about 14500BGP), or what I have (8700GBP) above is sufficient for both of us to survive?

2. How long will the above funds of 8700GBP last us averagely (considering if we are not staying with anyone and renting short term accommodation in London)?

3. Most of our friends over in London are renting but are single ppl living alone in 1 bedroom apartment.

- My question is, if we are to show that we have a place to stay (would most likely be sleeping in their living) would the EC officer see that it’s not appropriate accommodation and would require us to show accommodation evidence of 2 bedroom?

- Can our friend provide letter that she/he will accommodate us in their place but don’t provide the details of her/his place (ie omitting details of their place being a 1 bedrm apartment)

- If EC officer have problem with us sharing with friend in a 1 bedrm apartment, can me and partner stay in separate places (ie me in one of our friend’s apartment and my partner in another friend’s apartment)?

4. Me and my partner (my dependant) bought a property 9 months ago, however for tax reasons the property is under his name (though I have equal contributiion and share in the mortgage).

- Should I declare it or should my partner declare it when we fill the VAF1 form or should we not include it at all? If we are to include it in the application, what should I provide as evidence?

5. Will the EC office see owning a property as a liability (ie enroaching into our funds when we move to the UK though we are able to rent out our property when we are away) and from that, not grant us EC?

6. My HSMP approval letter had some typo, and I would need a revised and reissue of the letter – can I request for the approval date be updated to the date of the revised letter (or will Home Office revise and reissue letter with original date)?

Anyone’s advice/ input to the above would be greatly appreciated. Thanks in advance.

Cheers,
Y :D

Yes you can show your partner's earnings along with your's and no need to transfer his money, show up his own account. You have not told that have you claimed points for your partner as well. In both the cases you can show it and anything arnd £5000 is fine.

2. How long will the above funds of 8700GBP last us averagely (considering if we are not staying with anyone and renting short term accommodation in London)?

Well, you wud be spending arnd £800 - £1000 per month. This is for London and if you choose to stay anyhwhere else apart from London, the it would be cheaper. So with the kind of money u have, u can easily sustain for arnd 8 months.

No they are not at all concerned about your place of accomodation.

- Can our friend provide letter that she/he will accommodate us in their place but don’t provide the details of her/his place (ie omitting details of their place being a 1 bedrm apartment)

You don't even need to do this. Just provide the address of your friend's accomodation and nothing else.

- If EC officer have problem with us sharing with friend in a 1 bedrm apartment, can me and partner stay in separate places (ie me in one of our friend’s apartment and my partner in another friend’s apartment)?

I have answered that above.

I would suggest not to include this property at all. I presume that is a property against loan, so it is more of a liability rather than an asset. If it is not against loan then you can include it and show the property documents no matter if it's in your name or your spouse. I did the same thing as I had a property against loan.

5. Will the EC office see owning a property as a liability (ie enroaching into our funds when we move to the UK though we are able to rent out our property when we are away) and from that, not grant us EC?

I have answered that above.

6. My HSMP approval letter had some typo, and I would need a revised and reissue of the letter – can I request for the approval date be updated to the date of the revised letter (or will Home Office revise and reissue letter with original date)?

Not too sure on this as that's a unique case. I would still say it would be a new date and you should not request for any date as per your convinience. In any case you have 3 months at your disposal. You can choose to obtain the Visa close to the date you are planning to travel but should be 3 months from the date of the letter. It take just 2-3 days to obatin the Visa.

Dear Ashekt,

Thank you very much for your response to my queries...I apologise for the late reply due to the fact I have kinda given up checking on a daily basis for any response to my queries.
Seems like the moderators and the other members don't seem to respond to queries nowadays...I see that there are many ppl looking at the posts but no one is responding.
Anyway, thank you again...I can now apply for EC with a bit of peace of mind.

Cheers,
Yee Von

VY,

Don't know if this is still relevant but a comment on the response u received. You and your dependant have enough funds to accomodate yourselves without recourse to public funds. All u have to do is to make a booking of somewhere to stay for the first few days while u make your permanent arrangements. BUT, contrary to the previous comment, the ECO will be concerned about the quality of accommodation available to you. For instance, u can't stay with anyone in a building that does not have a bedroom dedicated to you.

- My question is, since my partner is my dependant, should I transfer his money into mine now (to increase fund evidence to about 14500BGP), or what I have (8700GBP) above is sufficient for both of us to survive?
Yes i think it is more than enough

2. How long will the above funds of 8700GBP last us averagely (considering if we are not staying with anyone and renting short term accommodation in London)?

Aproxi cost of living for one person it about 700-800 BP per month. if we take that you have more than one year moeny with you to Survive.

I dont think they dig that deep. two of my friends got same letter from there friends in Uk. but i think you should prepare for these answers.

- Can our friend provide letter that she/he will accommodate us in their place but don’t provide the details of her/his place (ie omitting details of their place being a 1 bedrm apartment)

Its batter if you ask them to show that they have two and they can spair room for you.

- If EC officer have problem with us sharing with friend in a 1 bedrm apartment, can me and partner stay in separate places (ie me in one of our friend’s apartment and my partner in another friend’s apartment)?

You can always tell officer that its going to temparory stay for atleast one week or obviously you are going to have your own in few days

No harm to show of property which you guys own. but i think no need to tell the reason that you have done that becos of tax reason. i think he would not like that.

5. Will the EC office see owning a property as a liability (ie enroaching into our funds when we move to the UK though we are able to rent out our property when we are away) and from that, not grant us EC?

I dont think so you can always sell it out.

6. My HSMP approval letter had some typo, and I would need a revised and reissue of the letter – can I request for the approval date be updated to the date of the revised letter (or will Home Office revise and reissue letter with original date)?

I have read the rules against approval letter. dont remember it clearly right now. check case worker guidence i think it there.

Anyone’s advice/ input to the above would be greatly appreciated. Thanks in advance.

Y :D
Good luck
