I have a valid Tier 1 visa (extended from HSMP) till February 2013.

I will be applying for ILR in January 2013.

So my earnings period will be from Nov-January 2012 to Jan 2013.

In March 2010, I met with an accident at Work and was on sick leaves for almost a year as I went for two Eye Surgeries in both eyes. I am still struggling with my work and not able to work Full Time. My basic salary is not 32K, which is what I have to show to get the minimum 75 Points. I used to get a lot of weekend project work which was compensating for my low basic salary. Now I am not able to do them.

Obviously, if I am not earning 32K, I won't get the minimum points. But it is not easy and not even certain that I will be able to earn such amount.

I would like to know how will be my case treated by the Home Office.

I have already decided to write a letter to them, explaining my situation.

Please suggest any other course of action, which I must take.

If I am not able to earn stipulated amount, which was caused by Injury at Work.

Do you think I have to go through Solicitor
