HSMP Settlement

Hi,

I need to find out if I qualify for settlement after 4 or 5 years. It's not as straight forward as I first applied for HSMP in late march before the 3rd Apr 2006 policy change. The first HSMP application was not approved as it was missing some documents. The re-application was then submitted later in April after the 3rd Apr 2006 which was approved in May 2006.

Will I fall into the category of "If you applied to the HSMP before 3 April 2006, received an approval letter and came to or stayed in the United Kingdom on the basis of that letter"

Help much appreciated.

If the second application was a "new / fresh application", then you may be eligible for settlement only after living in the UK for at least 5 years.

This is going to be painful as if it's 5 years, I am short of 55 days before I can apply for leave to remain after my hsmp runs out end of the year.

How can I find out if it's a fresh application? The initial application in mar 2006 was lacking documents and so I had to pay the second time for re-consideration. Does this mean the second application is a new one? Is UKBA able to tell me what the situation is? I had no luck with the general enquires so far.
