Tier 1 application extension or HSMP application extension

Post by Topaz » Sun May 22, 2011 4:43 pm

I am filling in the forms for Tier 1 extension (version 04/11) and see on page 7 of 62 of the forms, there are boxes that need to be filled in for either -

1)Tier 1 application or
2)HSMP Transitional Arrangements apply

Now I am not sure if I must tick 1) or 2)

I have gone to the policy guidance on page 35 of 35 of Annex B(last page) and suspect this may apply to me.

'On 30 June 2008, Tier 1 (General) was
introduced throughout the rest of the world,
and the remaining Immigration Rules for
entry clearance as a highly skilled migrant,
were deleted.'

I applied for an HSMP on 11th March 2008 from Zambia(which falls under 'rest of world') and got an HSMP approval letter on the 27th June 2008. But got a Tier 1 visa stamp in my passport in late August 2008.

I am now extending in August this year and would like to know if I should use

1) or 2)?

Please check page 7 of 62 it says

'Where HSMP Transitional Arrangements apply:'

'- the applicant is making a Tier 1 application'

The forms clearly are for extension and not initial application, I seem to meet the transitional arrangement criteria. ie applied before 30th June 2008 from rest of world(not India). Annex B page 35

Can you explain why you say 1) and not 2)

2) is Tier 1 application but under Transitional arrangements

You say Tier 1 general but both 1) and 2) are Tier 1 general, one under Transtional Arrangements and they other just straight Tier 1

Read the information given in the form before getting down to filling it. The answer to your question is given on page 4 of 62.
