ILR queries

Post by krssubbu » Mon May 23, 2011 10:09 am

Hi,

I am on Tier 1 visa and my ILR is due in Feb..Seen this new point system. Will these points be the same as for my initial HSMP or Tier 1 ? ( i mean age, salary because my age would be more now and wouldt be able to afford those 75 points) - so if points are awareded as the initial time, is it for HSMP or TIer 1

2. also how much maintainence funds i need to show and how long ?

3. My wife is on tier 1 dependant visa. In jan she will be 23 months in the uk ( i am eligible to apply for visa in jan as my visa expires in Feb) . i heard that depeneant visa will need to be in the uk for 2 years. so will this be ok ?

Thanks

1. See Tier 1 settlement guidance to understand the eligibility criteria for settlement as a Tier 1 (General) migrant.
2. As above.
3. On what date do you complete 5 years in the UK as an economic migrant? When does your wife's current leave expire?

Thanks susdmehta..

1. I have gone through the guidance and jsut to clarify, date of application for first grant - does this date mean my initial HSMP application..i got hsmp and later converted to tier 1. so points awarded for hsmp will be considered isnt it..just to clarify
2. it does not mention anywhere on the document how much maintainence funds are needed..for example during tier 1 extension i had to show 800 pounds as maintainence funds...is there anything similar to this ?
3. My visa runs out on 10th Feb 2012 and so as my wife's. she got her initial visa on 8th Feb 2010 and came to the UK on 11th Feb 2010. I am planning to apply around 15th Jan 2012..so would it be ok with her as she has not completed exactly 2 years and i wouldnt complete exactly 5 years. but i though you are eligible to apply 28 days before your visa expiires... she and myself have not been outside the country since this period

Thanks

1. Date of HSMP application
2. You are applying for settlement, and not Tier 1 (General) extension.
3. Should be okay, but to minimize risk of refusal (or being told that your wife may not be eligible) apply in the last week before your leave expires.
