Hello -

I am an American that has lived in the UK for 7 years and have gone to apply for the ILR only to be told the my salary is not enough for the points!!! I currently have a Tier 1 visa that will run out in September - I changed careers to work in the charity sector so my salary dropped considerably and now I am being penalised...

Can I appeal? Would a face to face appointment make a difference???

I am devastated - this is my home now and I don't know what to do!!

Any suggestions would be appreciated.

If you do not meet the requirements, your application is bound to be refused. Likewise for appeal, if someone is granted the right to appeal.

With your Tier 1 leave still valid, you do not have right of appeal.

Make attempts to augment your income, to help you apply for Tier 1 extension when it is due / ILR again.

it's sad that you have been refused. was you not aware of salary criteria?
did yo attached letter from employer confirming your COP code.

if you can exapin your situation it will help other who are going to apply in near future.

Tier 1 migrants are not required to submit any such letter!
