Unmarried Partnership - Applying from outside the uk?

Hi there.

My partner and I have been together for 2 years and living together for about 22 months. She has to return home in about 20 days due to her current visa expiring. She has been in the uk for 9 years and is a qualified architect.

If she returns home and lodges an unmarried partner application in July for example will they consider it or will they claim that the 30 days from when she left to the application being submitted is a break in the 2 years and therefore not applicable? If she is still paying rent in the uk and or if I visit her in August. Would this make any difference?

Normally you are permitted a short break apart during the 24 months, but this is when it falls in the middle of the 2 years. She would need to show evidence of the relationship continuing. The ECO could take the view that the application falls short of the qualifying period. If her current visa is still valid, if may be worth seeking legal advice to see if she can switch from within the UK using a postal application when she is short of 1 month. Do you have British Nationality?
UPV applications come under a great deal of scruitiny....even more so than Spouse visas.
