Query about Tier 1 general visa

Hello

This is my first post to this forum and I will really appreciate your help.

Me and my wife are currently on a Post study visa – Expires on 23-Jun-2011.

I have applied for a Tier 1 general visa on 28-Mar-2011 and I got the acknowledgement and Biometric enrolment letter on 6-Apr-2011, we have given our biometrics on 17-May-2011.

Now I am not sure how much time it is normally taking to process the application after Biometric. I have a doubt that my passport will come before my visa expires or not.

If I get a negative answer at the last moment, will i get any grace period to stay after my visa expires.

'Grace period', I believe, is 28 days [someone else can confirm this].

If you get feedback after your permit has expired, you will be given a right to appeal within 5 days of the date on the refusal letter. Once you've lodged your appeal, your status remains the same (in your case PSW status) till your appeal is heard or you withdraw your appeal.

Regarding 'waiting time', you'll just have to wait till you get feedback.

1. If a decision (refusal) on your application is taken before your current leave expires, you'll not be given a right to appeal.
2. If a decision (refusal) on your application is taken after your current leave expires, you will be given the right to appeal.
3. If you appeal within the stipulated time (the letter will state the stipulated time), then your stay will remain legal under section 3C .. until all appeal options are exhausted.
4. If you do not appeal the refusal, then you'll become an overstayer on the day following the last day of submitting an appeal.
5. If you overstay in the UK for more than 28 days then this may negatively influence any entry clearance application(s) in the future.
