Letter from Employer/Accountant

Post by abhayk » Sun May 29, 2011 7:51 pm

I have a question to ask senior members on the forum. My situation is quite simple in that I came into UK in July, 2006 on a 5 year work permit. Got my Tier 1 in June 2010 after which I left my WP sponsor to join my present employer. I am eligible to apply for ILR next month.

However, the complication is that I am leaving my present employer and am starting contracting (under my own company). In terms of providing proof of income, I have all my salary slips, bank statements and P60s. The problem I face is that by the time I apply, I will no longer be with the present employer so cannot get a letter stating that I am required for the job. As I would not even have completed a month contracting, I would not have any income or accounts to show. l

My question is :

1. Should I delay my application by 1-3 months till I have proof to show my income from contracting, or

2. Should I apply next month and just provide proof of the contract for work?

Any inputs from similar experience or pointers to similar posts would be very much appreciated.[/i]

Base your decision on
A new income requirement. Tier 1 (General) migrants must now meet the same income criteria that applied when they last extended their permission to stay in the UK.

I meet the income criteria and have the proofs for the period (June 2010 to May 2011), so not really worried about that. However, looking at a number of posts, I see that a number of people who have applied for ILR under Tier 1 (General) have provided a letter from their employer which mentions that they are required for their job.

But going through the SET(O) form, I also noticed that there is no mention that such a letter is required from the employer if under Tier 1 (General), only required if one is applying under Work Permit or Tier 2. Looking at section 245C and specifically 245CD, again I did not find anything regarding employer letter.

As I cannot arrange for an employer letter, I am worried that I may be asked about my future income and stability of the contract. Based on posts below, I am worried that this could be a point for refusal.

My question is can they refuse on the basis of future income/ job stability (contract is for 6 months) and if yes, then given my situation, how can I can meet the requirements?

You do not have much choice. If youre doing your own business, you will need documents from your accountant, similar to the ones mentioned in the posts you have quoted.
