Hi All,

I am looking for help regarding

"Settlement for a baby who born in UK and lives in India till Parents get FLR".

Initially, I got my HSMP valid from 01.04.2008 to 01.04.2010.

I have extended Tier 1 (General) which valid until 01.04.2013 and my wife status is Tier 1 (General) Dependent valid till 01.04.2013.

We are expecting baby during end of September 2011 in UK.

I am planning to send my family to India during end of November 2011 and planning to apply leave to remain during Mar 2013. I have a query below queries:
1.Can I send my kid without any visa just having Indian passport?
2.If yes, Can I apply leave to remain / settlement from India for Kid?
3.If not from India, Can I apply British passport for my kid when I will apply leave to remain for me during 2013?

Or please suggest me the best option to do this.

Any form of "leave to remain" can only be applied for from within the UK.

1. What leave to remain will you be applying for in Mar 2013 - (limited) leave to remain i.e.- extension or (indefinite) leave to remain i.e. - settlement?
2. When does the child intend to travel back to UK - after you are granted (??) leave to remain in 2013 or before?
