What else we can do....during decision or waiting period ???

Hi All,

My Tier 1 extension is due on Nov 15th and my visa is going to expire on Dec 15th 2011.

I see that - it is quite time consuming by home office for processing application. What is the tentative timelines for Tier 1 extension processing ?

My question is :
1) What will be my employment status. Will I be able to work during this one month period of time ? Is it legal to work during this period ?

2) What if - they take 2 months of time for processing and making the decision for my application ? Since my visa is expiring on 15 Dec 2011. So bit worried regarding the same.

3) How is the stay considered after visa is expired ? What will be the situation for those - who gets negative decision after expiry ?

If you make an in-time, valid application for leave to remain (extension) and if a decision on the application remains outstanding until the expiry date of your current leave, then your current leave will be deemed extant under section 3C.

If you receive a refusal before your current leave expires, then you may apply again before your current leave expires.
If you receive a refusal after your current leave has expired, then you will be given the right to appeal.

depends on the UKBA

Your current visa status will remain so nothing to worry about

if you are unfortunate, you may get a chance to appeal
