ILR dependency issue

Hi guys

I need some advise regarding ILR application for my wife.

I am currently on a work permit and due to apply for ILR in August next year. My wife is currently on a Tier 2 visa and qualifies for ILR in Oct 2013. From what I've gathered, I cannot include her as a dependent on my ILR application as she didn't originally enter the country as my dependent.

So is it possible for her to go back to her country and residence and get her visa switched to a dependent visa under my work permit before I apply for ILR? My understanding is that the 2 year cohabitation rule does not apply as I'm on the old style work permit (issued in July 2007) and not tier 2.

Am I missing something here?
