Spouse visa Break up -

Hi all

I am looking for some urgent advise please.

Me (Non-EU) and my girlfriend (BC) got married last year and I was granted Spouse visa valid till 2012.

Long story short but things did not work very well and she decided to give me divorce

I understand that she is unable to divorce me until 1 year of the wedding which is completing next month.

Before spouse visa I was on student visa and finished my degree.

I was advised to apply for Tier 1 G before 05th April.

I applied for Tier 1 G in March 2011.

I received HO letter yesterday and they granted me all Points to qualify Tier 1G but unfortunately advised that I am not allowed to switch from spouse visa to Tier 1 G.

I have been going through this forum and found some useful advise by John and some more seniors who advised some other members to apply for Tier 1 or Tier 2 who were in same kind of scenario.

Please correct me if I am wrong and kindly guide me.

I was advised to apply for Tier 1 G before 05th April.

Whoever suggested that to you was unaware of the rule(s).
