Knowledge of language and life test for ILR

Hi,

We have a bit complex(as per me) situation.My father is in UK on spouse visa for 27 month which is going to finish at the end of December 2011.As per the law he is supposed to give the life and language test in UK.However he will turn 65 in the first week of January 2012, so he would be eligible for exemption.So there is a gap of around 10days within the expiry date of visa and the 65th birthday.Can somebody please advise that how we should submit the application to get exemption from language and life test?
