IGS --> Student --> PSW ?... (Help Required)

Dear All,

I have been trying to get a definite answer but so far i have not received any. Basically i came to UK in 2004 for my Bachelors. After completing my bachelors i went back to my home country in 2007. In 2008 i applied for IGS from my home country and i received 1 year's IGS. I never traveled on the IGS and hence never used this visa in terms of immigration clearance.

In 2010 i came back to UK for my MSC which i have just completed in June 2011. Currently i have 6 more months on my student visa to stay in UK. My question is,

Will i be eligible for PSW after getting my MSC degree?
Do i fall under the transitional agreement of IGS and PSW?

As i have asked this question to so many solicitors and no one has given me any definite answer on this. Could you please help me on this? Your quick reply would be highly appreciated.

I don't think you can apply for leave to remain as a Tier 1 (PSW) migrant (245FD(f)(vii)).

That you did not enter UK (after you were granted entry clearance under IGS) was a choice you made. From an immigration perspective, you were previously granted leave in a category that restricts grant of leave to remain as Tier 1 (PSW) migrant.

Transitional arrangement (245FE(a)(i)) applies only to those who have or were last granted leave under FT: WISS / IGS / SEGS. In your case, you have and were last granted leave as a Tier 4 migrant, so the transitional arrangement doesn't apply to you.
