WP Holder ILR Eligibility

Dear All,
Please check the details and advise us that are we all eligible to apply for ILR in January 2012. I go through the previous forms, but still I would like to double check with you guys before I proceed.

My Visa Details:
Working Holiday Maker Visa 01-January-2005 To 01-January-2007

Workpermit 5 years (Old System, Not Pointbased) 01-Feb-2007 To 01-Feb-2012
Immigration Stamp on 01-Feb-2007
Working for the same employer since 2005 to till date.

My Wife Visa Details:

Workpermit Dependent visa 16-May-2007 To 01-Feb-2012
Immigration Stamp on 22-May-2007

My Uk born 18 months Baby
Workpermit Dependent visa 22-July-2010 To 01-Feb-2012

Are we all eligible to apply for ILR on 03-January-2012. Please advise.

Assuming that you were in the UK on 01 Feb 2007, and had leave to remain as as work permit holder, then you may all apply for ILR from 4 Jan 2012.

Baby doesn't need to, if you intend to register baby as a British citizen after being granted ILR.

Thanks for your prompt reply.
As my visa expires on 01-Feb-2012, do I need to renew My workpermit visa before I apply for ILR?
or shall I directly apply for ILR?
Why I am asking..
for ILR, WP holder needs to apply 28 days before 5 year visa completion date ie my visa expire date too

and I think ILR processing takes 6-8 weeks (2 Months), so in that time my visa status is nothing.. I mean I have no visa
Is that okay!!!
