Tier 4 visa Refused !! Help If you can !! Thanks

Post by paindoo » Tue Apr 26, 2011 10:28 pm

Hi there !!! i am a student of the university of westminster. I made an application for FLR tier 4. The UKBA refused the application on the basis that i didn't have sufficient funds to meet the criteria of Tier 4 and that the financial sponsor ( my dad) didnt have a proof of the relationship. Currently i made an appeal against the decision. Got the family registration certificate from back home , bank statements (both my mother and father that exceed £ 1600 well over for over 28 days ) ,their passport and national id card copies, official letter stating that i have access to the funds. I have gone for an oral hearing which is due next month.

FurtherTo add i have paid full fee for the year , that i was granted leave for 6 years, that i have got 30 points for cas . should i accompany an immigration lawyer for the court hearing ? or you think its a straight forward case ? Please help

Did your parents have the funds on the day of the application and for a consecutive 28 day period ending no more than one month before the application?

In that case why did they refuse on the basis of insufficient funds

They refused it due to the fact that i didnt have proof of the relationship between my father and myself !! ( i know that sounds crazy ) but the law says you need to show your birth certificate ... whereas my understanding was that on my passport it clearly states my father name. And plus an offical letter stating the relationship.

If you believe you have evidence to show you met the rules on the date of the application then you probably don't need a solicitor as the appeal should be straightforward.

I think you meant £16,000. Because £1600 isnt enough is it?
When we applied we had about 16 lac rupees in the account. which is equvalent to about £12000.

You need to show the birth certificate for this.
