Edge of filing ILR SETO form - Need Advice

Post by jabeen » Sun Jun 26, 2011 1:42 am

Hi all,

Can any one suggest or had same sitution like mine.

I'm running 8-10 days short to file my ILR application. I was granted tier 1 general visa for a total period of 4years 11 months and 20 days (with one extension).

I'm not sure if I can apply for my PR or do i have to go for another tier 1 extension to cover these 8-10 days then apply for PR

Please guide.

Many Thanks.

you can apply the ILR 28 days before your 5 years. In your situation, you can apply 4 years 11 months and 3 days after the first day you enter UK.

For the application of ILR, the requirement is that when you submit you rapplicatioun, you have to have a valid visa.

Can you please elaborate the details. Date of initial visa, entry in UK, Type of visa etc. Since you are only 10 days short of 5 years and ILR is permissible 28 days less than 5 years. It should be ok 2 weeks before your visa expires. Also see this
2.2 Applications that fall short of the five year continuous period
In some cases, applicants may have been granted 5 years continuous leave, but will not have
spent 5 years continuously in the UK before their current leave expires. Caseworkers may
count the period between entry clearance being granted and the date the applicant entered
the UK towards the 5 years, provided this period was not longer than 3 months
