Tier 1 dependants Visa for spouse who is on Tier 2 visa

Hi,

I am an Indian Citizen, currently in Edinburgh, UK on a Tier 1(General) Visa eligible to stay till July 2012. My Wife, also an Indian, is in Edinburgh, UK on a Tier 2 General Visa sponsored by her company. Her visa is coming to an end in Sept 11, she would like to stay with me and hence wants to apply for a Tier 1 Dependent visa under my visa.

1. While staying in UK, can my wife apply in UK to become my dependent after providing relevant documents and fees? Or will she have to return to India and apply for a Tier 1 dependents visa from Indian?

2. If she leaves UK, will the 2 year (2009 to 2011) she was in UK as a Tier 2 be counted towards the 5 years required for PR?

1. She has to apply from India

2. No but she doesn't need to complete 5 years to qualify for ILR if she applies as your dependent See 319 E.
