Asked to provide Tax Return certificate

Hi all,

I got a letter from HSMP today asking me to provide more information about my past earnings. Explicitly they have asked me to send Tax return certificate. Now the problem is that I was unable to deposit my tax return certifcate for the last year as I left a job and remained jobless for almost four months, at the end of our financial year.
Now I would like to get an experienced suggestion for you all (Kayalami etc..) what should be the best ploy to adopt.

remember I was telling you that you may receive the letter soon. So some letter has arrived. Unfortunately its not the final decision. One thing is clear that they have passed processing of 18th march. So very soon neo__x will get a reply.

One precaution, try to submit what they have asked for. Your locals can help you much better with the IT(income tax) rules

wat has the case worker asked for ?..it is tax return or tax return certificate . so far I know tax return is wat u submitted to tax authority for a corresponding year as declaration regarding income and tax return certificate is the certificate which is given by tax authority. U told u was unemployed for 4 months. so wat was ur income year claimed for HSMP point ? didnt u submit ur tax return when u was employed?

In my case I submitted application in Jan ' 04 and claimed for income for the year Jan ' 03 to Dec '03. And include my tax return ( not certificate) for the income year Jul'02 to June'03 along with other income related paper. The base time for income tax return is July to June in our country. The case worker accepted my case as I have got approval.

I have already sent them
(1). Bank Statement and
(2). Pay slips as proof for Past earnings,
now why have they asked me for this third evidence to send them Tax Return Certificate. As far as I know they want two proofs to be submitted to prove Past Earnings.

Any body with any idea?

Perhaps for the cross checking..
BTW wat is the first line of this letter u got from case worker ..it is in this way ..." We have considered your application.......OR " We are currently considering your application...."

It states that "We are currently considering your HSMP application ....Before we reach a decision we need further information."

And down there they have asked me to provide them most recent Tax Return to corroborate my claim.

What do you think SNM I should better do ?

Dear Hafeez

If your inability to submit Tax Return for the correspondence year is supported by your country's Income Tax Rule then

1) you can explain it to the case worker along with a certificate in this
concern given by local registered income tax practitioners / advisors.

2) AND you can submit your company's certificate in it's letter head pad
stating your's past earnings from the company( though u have already
submitted pay slip ). I think, at least, it will be 3rd evidence to the
case worker to reach a positive decision.

You probably have some tax deduction certificate if not your tax return for the 8 months that you worked and the employer deducted tax for you.
Send that so that HO can see some proof of tax payment for your earning.

I have got Tax deduction certificate from my employer which is a legal document. But I am not sure whether they will like it or not.
If they do not like it and don't award points to me against Past earnings, will they award me points for Work experience as I have applied for 50 points.
By the way, they have asked me details about my projects as Specialist role. So the question is If they accept these details, will I be able to get those 50 points that I claimed? or ...

No reason for you to doubt the acceptability of the tax certificate from your employer. You can try and get a letter from your company on letter head explaining the validity of the certificate. Something like...

This is to state that Form-so-n-so is a legally valid document of Tax deduction under section so-n-so of Income Tax Act of so-n-so country. The attached document details the tax deducted for Mr Hafeez xyz for the period from xxx-zzz.

Make sure this is signed by the Accounts/Finance head . Or alternatively a registered chartered accountant can also give you on his letter head in case you find it difficult to get it from your company.

In India there is a Form-16 document which suffices in place of a Tax return in such situations.

As for your second query, as per my understanding the points for work experience are also dependent on the earning proof points to a large extent. In case you are unable to get the the earning points, the other will also be in jeopardy.

What kind of specialist role are you trying to get points for ?

You are right and I too would like that they accept it. I got Tax deduction letters from my employers that contains almost the same wordings, signed by respective Accounts Officers. But it does not show all the amount that I earned that year because I worked some part time jobs as well. Neglecting these part time jobs I cannot show the required amount to score points. And I have already provided them letters from those Accounts Officers, stating the salary and tax deducted.
I have repeated it a number of times that I have provided them three proofs in regards to Past earnings.
1. Pay slips
2. Letter from Account Officers
3. Bank Statements
4. And now they want Tax Return certificate

Is n't it a misery, do n't you think so. Anyways, I am going to provide them as much docs as I could manage. Let's hope that this time they are content with these docs and send me their approval letter or my originals back. Waited for so long

In that case, the case worker is looking for the tax return for your complete earnings. As you mention without the part-time earnings you are not able to claim earning points, hence the case worker may be looking for a confirmation before he/she decides upon the earning points for you.

Hafeez, i suggest you pray real hard. If your specialist level prrof is fairly fool proof you may get points for that and sail thru to a approval. All the best.

I think the HO should clearly mention in the guidance notes if they work on earning figures based on taxed earnings only. Just mentioning that they need any 2 proof of earnings is misleading.
