Tier 1 Dependent - Maintenance Funds

Hi,

If I understand correctly, the requirements for the maintenance funds is the following:


(a) Where the application is connected to a Tier 1 Migrant (other than a Tier 1 (Investor) Migrant) or a Tier 1 (Exceptional Talent) Migrant who is outside the UK or who has been in the UK for a period of less than 12 months, there must be £1600 in funds.

(b) Where:
(i) paragraph (a) does not apply, and
(ii) the application is connected to a Relevant Points Based System Migrant who is not a Tier 1 (Investor) Migrant a Tier 1 (Exceptional Talent) Migrant or a Tier 4 Migrant there must be £533 in funds.


I have recently been granted my Tier 1 visa, but have been on Tier 2 visa with frequent short visits and longer 6 - 9 month stays over the last 5 years. On the classification above, would I be categorised as someone as who has been in the UK for less than a year (given that my Tier 1 was only approved since last month); or would I be categorised as someone who has been in the UK for more than 12 months and hence would £533 per dependant and £800 for self be sufficient in terms of maintenance funds for my dependents?

Any help/thoughts is highly appreciated.

It does not matter if you are granted Tier1 now. If you were in continuous UK salary for past 12 months then you have to show £533 for your dependant. But if you were off and on to UK on non-UK salary and UK-salary, then you have to show higher maintenance funds.
