overstay of 28 days after visa expiry date

overstay of 28 days after visa expiry date

Hi All

My PSW visa is expiring on 1st Aug 11, I have decided go back to my home country, I am finshing my all pending matters during this period,

I wanted to know that can I stay 28 days more from my visa expiry date which is 1st Aug 11, means can I stay upto 28th Aug 11 or shall I have to leave this country on or before 1st of Aug 11, I have not seen any rule of stay of 28 days after the visa expiry date.

Your answere will be much appreciated.

If you voluntarily left the UK in 28 days or less from the expiry of your leave, then 320(7B) should not be used against you.

However, it is still not a good idea to overstay. It is a criminal offence. There isn't a mandatory refusal for people who have overstayed for 28 days or less. Nevertheless, I could see you having trouble convincing UKBA that you will not overstay in future having overstayed in the past. It may also effect applications to other countries.
