Post by meryaan » Sun Jul 03, 2011 9:38 pm

hi i have a question. i am a british citizen and i live with my husband abroad.
we have been together for 4 years and we have 2 daughters together both are british citizen by birth. i come uk from time to time but mostly i live abroad with him.last year my husband applied for a family visitor visa and he was granted. we came together to uk and he stayed for 10 days and went back home because of work, i stayed in uk after some months my husband came again when his visa had only 5days left and he stayed for one and a half month and went back home.he wants to come again now for the third time and he applied for family visitor visa for 2 years am not sure if they will refuse for him because of overstaying. please i need your advice do you think he will get visa or not?he only wants to come and take me back home with the kids so that he helps me with kids during our journey. he doesn't want to come and live in london coz he has a job abroad. he only wants to come to visit when i travel to london.please help me

If it has been less than one year since he left the UK, then they may refuse him under 320(7B).

When he's next visiting the UK, he should try to pass the KOL test.

what if he has a good reason for overstaying?because it was his first time to uk and he didnt know the rules of the visa.some people were also telling him when your issued with a visa the expiry date on the visa only applies when your abroad and when you enter uk you can stay for 6months.so it was a misunderstanding he didnt mean to break the rules on purpose. why does he need to pass the KOL test if he only applies for family visitor visa?oh am so worried i hope he gets the visa.

Very worthwhile prior to a spouse visa, if he wants to settle with you in the UK in the future.
