Hello,

I am on Tier 1 General visa and reside in UK. I came here last year while my husband is in UK since 2006 on student visa which then got converted into Tier 1 (Post Study Work). we got married here in uk.
Now my husband's PSW is gonna expire by the end of this month.he intends to apply as a dependent of mine.we thought it would be simple.but having gone through the application guide for pbsdependents, I came to understand that he cannot apply while stay inside uk as he has not previously been on any dependent visa. I am confused. does he need to go back to his homeland and then apply for dependent?this was the case with students but never heard for those who are already on tier 1.
please suggest.

yes he will have to go back to the home country and file using VAF10 form.
