EU Fam card application based on my Irish Citizen Child?

Post by xxxtieee » Thu Jul 07, 2011 10:26 am

My baby girl (1 year old) is an Irish citizen. As her parents, can I apply for EU Fam card?

As I understand, a non EEA family member of a EEA citizen can apply for this. Has anyone tried this with results?

Thanks

I was adviced by the Citizens Advice to apply under it and see what happens. Theoretically we (parents of Irish Citizens) should fall under that category.

I would love to hear someone's story about this

No you cant apply. You child is an Irish citizen, who has always lived in Ireland. He therefore dont not benefit from the citizens directive which confers the right to Resident to family members of EEA NATIONAL.

Eufam is generally issued to the non-EEA National family member of EEA NATIONAL who are exercising treaty rights in Ireland, or Irish citizens returning home with their family members, after having exercised treaty rights in another memberstate.

The most you can benefit from is Zambrano Ruling.
