Hello everybody ... I have a situation ...

First of all, I'm Romanian, so A2 class country category. I have the right to work in UK as Self Employed, as EEU citizen, but not the right to work as full permanent employee.

I'm in UK since July, last year.

I tried to register myself as Self Employed (I'm a self employed for real, freelancer web designer), but since the end of 2009, or something like that, you need NINO first. OK

I was looking for clients since the beginning of August, and in the middle of the September I was attending to my first EOI at JobCentre Plus.

My application was refused. Not enough invoices, no clients references ... no problem, it's normal.

Since then, I was working, getting clients, earning money, establishing even a permanent collaboration with a British Web Agency & IT Company... so, I asked for another EOI.

Their answer was another refusal letter: "Your application has been refused because you have failed to provide sufficient evidence of your right to work."

For the interview I had my valid Passport, National ID Card, both rental agreements, UK bank statements before and after I changed my address, about 15 invoices (even for clients outside UK: Luxembourg, France, USA; proven contracts through my bank statements, all money entered in UK through wired transfers), clients references with landline number, landline redirected to mobile in case of not answering (they didn't call the guy).

I called them ... they transfered me to another department, those guys told me ...no, you have to call them back .... called them back again ... again transfered to another department ... back again, got some number nobody answered .... no results.

Now, my problem is not this NINO, I don't care about having this number, and I don't care about claims, benefits and so on. But it seems without this NINO I can pay taxes as Self Employed, because I can't register myself as Self Employed without NINO. So, please advice ... any idea about where to appeal to their decision ... (not general stuff like HMRC :) ) or how I can pay taxes without their stupid numbers :) ?

I really don't understand why you are having a problem. Your right to work is based upon your nationality. You are fully entitled to be self-employed in the UK.

Even just page 1 of this UKBA document proves you have the right to be self-employed.

Yes, I know ... it's very weird ... honestly, it seems to be a way to not let you to exercise your treaty rights ... confusing you ... and hoping you will quit.

The question is where to go or call ? Because it seems they also have specific strategies to transfer you from a irrelevant department to another irrelevant department. Somebody really love Kafka :).

Hey guys, I am from Romania aswell I work in IT, I mainly fix computers, laptops/desktops/networking I started as Self Employed and I have already made customers. I got everything ready for the interview and the lad that interviewed me he said I am extremely well organised and he thinks I should have no problem in getting the NINO but if I don't get it from the first application I should wear them out. So according to my knowledge they will refuse you hoping you will give up. Keep doing your job getting more invoices and apply over and over again!

My answer was the same as yours. "Failed to provide sufficient evidence" is like saying, thank you, come(try) again. Hope I am not wrong on this one.

I'll tell you something. I've helped someone with the NINO App. (making sure the file is in order and contains all the required documentation) (I am an immigration adviser and accountant) and to my surprise the application was refused. I was astonished and called the Jobcentre Plus Cardiff myself. They said that "maybe she did not have that or that or that...", but she had all the documents needed. And at the end the "nice lady" said"...oh, maybe she was refused as she is a Romanian national"... So, what do you think? Only beloved?... Or more?...
