PSW to Spouse do I include Child?

PSW to Spouse do I include Child?

Hi Guys,

Firstly well done on the great advise and support you give to hundreds of people in this forum.

I would appreaciate if you can advise on the matter below.

I am currently on a PSW after completing an MBA, visa is expiring in Feb 2013.
On my application for the PSW late last year I did not include my 1 year old son as a dependent as his father assured me he would apply for a British passport for him as soon as his ILR is granted as my son is born in the UK.
Though we had split up 4 months into my pregnancy we were on good speaking terms until recently when I got married to some else whom treats me in every aspect better than my ex ever did. The relationship with my baby's father is none existence and he has point blank refused to apply for his son the passport and we are not on speaking terms.

I intend to switch from the PSW to Marriage visa as my husband is a ILR holder and is more than happy to sponsor my son and I on the application.

The underlying question is, would the inclusion of my son on my application as a spouse of a settled person cause any problems as I did not include him in my PSW application?
Or do I wait for 2 years to apply him a British passport once I get a ILR? Simply am confused as will not be able to travel with my son abroad until his status is sorted out.

If travelling, then you may include son in your FLR(M) application. Else, your son does not need to make an immigration application.

Will child under 6 need Biometric appointment?

Another question for you, do children under age of 5 require biometrics to be taken for dependent visas? As I want to sent my application by post?
