Switching from Tier 2 to Tier 1 Dependent in Uk

Switching from Tier 2 to Tier 1 Dependent in Uk

Hi,

i just read an article from UKBA site stating " Switching in to the dependant route "

Currently i am in Tier 2 ( Intra company transfer) Visa holder and my wife holds a Tier 1 General visa.Legally i can be switch to her dependent Visa by going back to India and apply from there.

However the new rule says that you can switch to dependent visa as such from within Uk itself .Without need to leave Uk for converting your Tier 1 dependent visa.

there is no new rule, you cannot switch in country, you need to return home and apply for entry clearance.

See 319C(h)

However could you please expain about the Switching in to Dependent route, which says tht the Work permit holder are eligible to apply for Dependent with in Uk..

In these case could be please provide in detail that who are eligible to apply in these route

i think you are misreading the link you have posted as no where does it say that 'work permit holders' can switch into the PBS dependent category. In any event you are not a work permit holder. It is only those who last had leave as a dependent who can switch. Read your link and my link again.

Further to your private message, you are missing the point

1) the link you posted, and the rules, only refer to people who have been granted leave as dependents of work permit holders, students etc. It does not say that work permit holders themselves can switch.

"How you can switch in to the dependant route

You can apply for permission to stay here as the dependant of a highly skilled worker without having to leave the United Kingdom and apply for entry clearance if your last grant of entry clearance or permission to stay here was as the partner or child of:"

2) In addition, a work permit holder is not the same as a Tier 2 ICT migrant. Work permit holders are a pre-PBS category.

You cannot switch. You need to apply for entry clearance.
