Dependant visa renewal

Post by nileshkmakwana » Thu Jul 21, 2011 2:58 pm

Dear Friends,

I had work permit initially, but after a year and half I got HSMP tier 1 visa. After getting my HSMP Tier 1, my wife applied for dependent visa. My work permit was getting over @ December 2012 while my HSMP Tier 1 finishes @ April 2012.

When my wife applied for dependent visa, she got stamped of HSMP Tier 1 dependent visa till December 2012. In this case her visa finishes in December 2012 while my visa finishes in April 2012. In this case when my renewal comes (i.e. April 2012), can i apply only for my own visa?

The reason behind it is I will be eligible for PR / ILR in December 2012 because I will finish 5 yrs of working. Is this OK if we apply for PR directly instead of renewing my wife's visa in April 2012?

Can anyone help here?

Thanks in advance

Yes she could apply directly for ILR. However, please keep in mind that sometimes CW ask for cohabitation proof for 2 years. So if you have that then there should be no problem at all, provided all other conditions are met.

Thanks for your reply. So it means next year in April 2012 I just need to renew my visa. Is it?

Again I have all proof that my wife is with me from last two years in UK and we do have marriage certificate plus my name is also in my wife passport as partner name. it means in this case I can go only for my visa renewal in April 2012 and in December 2012 i can apply for ILR with my dependents. Is that right? If anyone has any home office document link, which gives this kind of information, please give me a website link.

Thanks
