applying for ILR and a querry

Post by dr_raihan29 » Fri Jul 22, 2011 10:11 am

Hi there,
will be applying for ILR in october, I think it should be a reasonably straightforward case with me being under JR(april-nov) and applying after 5 years with my wife who has been with me here for the whole 5 years and uk born child. I wanted to know what happens if in the unlikely event of being declined an ILR on the day of PEO appointment(I plan to apply about 10 days before expiry of my current tier1 leave), if its declined do I have the option of applying for extension/can i reapply with other documents if needed within 10 days or do I need to leave the country as ILR is unsuccessful?. many thanks in advance for the reply

Little pessimistic approach. Ilr refusals possible scenario
1 Break in continuous stay 2 Use of public funds 3 General grounds
4 Security hazards

Pre Nov applicants rules etchttp://www.ukba.homeoffice.gov.uk/policyandlaw ... es/part6a/

You can appeal against decision, or apply for extension if not meeting criteria for ILR, etc. It is not a abrupt decision. They give you chance to prove your case

thanks for your reply much appreciated. I initially wanted to apply at belfast where i live but decided against it and decided to apply at places like croydon or shefield where I guess they would be a bit better experienced regarding JR cases i.e not needing LIUK, no point based etc. keeping fingers crossed.
