Dear Members,

My initial tier1 visa was valid from 1st june 2009 for 3 years, but I came to UK after 35 days(on 5th july 2009). My extension is due on next year june. I am well aware of the fact that I need to do the extension twice before ILR, as I am not within the "28 days". In this case I need not wait until april next year to extend the visa as extending it early is less tension and stress. Is this fine? Is there anyway they can extend my visa for 25 months or so so that I can apply for ILR after one extension?

Hi Varghesejim,

Unfortunately, you can't extend your visa for 25 months, as it is not in the rules.

If your extension application is very straight forward, you can delay applying for your extension until your visa is almost expired.
When you apply, you will need to wait for some time to get a biometric appointment. Try and choose an appointment date far into the future to enable you cover up the 35 days you are missing.

By the time you eventually have your biometrics taken and sent to Home Offie for processing, you should have made up the time.

Please note, take this advice only if your application is straight forward. If it is not so straight forward, I guess you'll need to extend twice to be safe.

In addition, this is just a suggestion. There is no guarantee that what I have suggested will cover the time period you need to qualify for ILR without another extension, so please do not just take my view without doing more research.

Rules have changed for ILR.

After changes made on 5 April 11. Applicants who came to UK within 3 months of visa stamping need not to apply for 2nd extension.

Search the forum and UKBA site to find the relevant news and policy document.

I have discussed this topic in the past too. Search me posts if you cant find any clue.
