Residential qualifying period and ILR

Post by Jon.Scott » Wed Jul 27, 2011 2:58 pm

My wife has been resident in the UK for nearly 4 years but due to the 'life in the uk' requirement we have only just made the application for ILR.

Basically 2 years ago we extended the 2 year spousal visa instead of doing ILR. SHe's been legal the whole time with no exceptions.

My question is, can we apply for Citizenship as soon as the ILR arrives?
This was my previous understanding, but some sources of info state that she must have held the ILR for at least a year. The UKBA site does not specify this however. I assume those who say you need to have ILR for a year are assuming you got ILR immediately after the first 2 years had expired.

Thanks in advance

Jon

If you are British, your wife can apply for BC immediately after being granted ILR.

Yes I am British.

That's reassuring thanks very much. Just the thought of another years wait had me sobbing.
