Can I include out-of-UK earnings for renewal of HSMP

Can I include out-of-UK earnings for renewal of HSMP

Hi there,

I'm holding HSMP till May 2013.
I'm planning to leave UK, to work in Ireland till Dec 2012.

I'm thinking of coming back to UK & work in Jan 2013, so that I will be able to renew HSMP.
When I renew HSMP, can I include my Ireland earnings to produce the 12 month earnings ?

You may do that however in my limited understanding:

1. if you claim points for uk experience during renewal, you need a minimum amount of earnings from UK (check respective guidance note for exact amount, I think its 16K or so)

2. You may have difficulties convincing an immigration officer at the port of entry in UK when you return that you intend to continue work in the UK.

3. You might fall short of residence requirements for ILR at a later stage in case you intend to apply for it.

Mostly we will be travelling (roadways) to Northern Ireland and then to mainland. So Is there a chance that we can bypass this problem ?.

Not sure but I guess land borders are usually more reasonable.

There is no "port of entry" between Ireland and UK even when flying, so no need to worry about this too much.

The common travel area in my understanding applies only for nationals of the UK & Ireland (and probably also those on settled status), not for other nationals who are still subject to immigration control.

Regardless, there are no border controls when entering the UK from Ireland. The last time I flew to Dublin though, I had to go through border control upon entry in Dublin, but all other times flights have been treated as domestic flights inside the UK. There are no immigration officers to question you upon arrival back to the UK.

Agree with what mulderpf said. When I arrived into London from Dublin (forget which London airport) there weren't immigration controls or questions. I asked a few times because I wanted an entry stamp in my passport, but they said no not possible it's CTA.
